「プライバシー」は難しい！

　　田中真紀子前外相の長女に関する記事を載せた週刊文春が販売を差し止められたことが先週話題を呼んだ。伊藤編集部員も先日日記で書いていたが、なかなか難しい問題だ。

　　3日前、この日記の愛読者だというNさんから、問題について「論点が違うのでは？」というメールが来た。「表現の自由と個人のプライバシーという比較考量の問題にしているからヘンなので（裁判所の判断は）『検閲の禁止』に抵触し、違法な処分だと思う」とNさんは言う。争われている内容がどんなものであっても、事前検閲が憲法違反に当たる以上、違法になる、という理屈だ。

　　この問題では、活字メディアのスタンスがはっきり分かれた。文春の記事を「プライバシーの侵害」とした新聞と、「表現の自由に抵触する判断」とした新聞だ。後者の側は特に、販売差し止めの仮処分決定が1人の裁判官の判断で下されたことに疑義を挟み「せめて本訴で審理するべきだ」と強調した。

　　この根底には、同じ活字メディアの新聞と雑誌の間にある、複雑で微妙な「落差」が横たわっている。少年犯罪を中心にした「スキャンダル報道」では、新聞は雑誌を「やりすぎ」と冷ややかな目で見る。逆に「メディアスクラム」や「報道被害」でいえば「大規模取材を展開する新聞の方が罪が大きい」というのが雑誌側の本音だ。毎年秋に行われるマスコミ倫理懇談会全国協議会の大会などでも、そうした立場や姿勢の違いからしばしば対立してきた。僕個人も時々、雑誌の報道にはうんざりすることがあるが、だからといって、新聞側の主張ばかりが正しいとは思わない。そうした「メディアの分断」が、個人情報保護法などのメディア規制法がまかり通る土壌に結びついていると思う。

　　さて、Nさんの指摘だが、新聞によれば、1986年の北方ジャーナル事件の最高裁大法廷判決で「新聞・雑誌の販売差し止めは（事前）検閲に当たらない」という判断が出ている。しかし、差し止めが認められるのは例外的であり①表現内容が真実でないか、公益を図る目的でないことが明白②被害者に重大で回復困難な損害を与える恐れがある―場合とされる。

　　共同の調査部で問題の週刊文春の記事を読んでみた。仮処分の判断が出る前に書店から届いていたそうだ。記事の「趣味」はたしかによくないし、本人が書かれたくないという気持ちは分かる。しかし、販売差し止めをするほどプライバシーを侵害した内容だとは思わない、というのが僕の感想だ。その点で言えば「表現の自由」派メディアの主張に近い。

　　でも、そう判断できるのは、読んで内容を知り得たからだ。要するに、内容が分からなければ①②の判断はできない。では、これがもっとひどいプライバシー侵害の記事だったらどうだろう。例えば①②の条件を満たすような。それでも、読まなければ分からないから販売差し止めはおかしいと言えるだろうか。

　　僕も、基本的には販売差し止めは極力慎重にすべきだという意見だが、それでも、なかなか難しい問題だと言うのはそういうことだ。これでいいでしょうか、Nさん？
